BK Modules LLC (operated by BK Modules) is committed to protecting your privacy. This Policy explains what personal data we collect, why we collect it, how we protect it, and what your rights are, in accordance with Regulation (EU) 2016/679 (GDPR), and where applicable, the California Consumer Privacy Act (CCPA/CPRA). This Policy constitutes a legally binding document between you and BK Modules.

1. Data controller

BK Modules, a limited liability company organized under the laws of the State of New Mexico (United States), with registered address at 102 Gold Ave SW Albuquerque - NM - 87102, telephone +1 (813) 214-0078, is the controller of personal data collected through https://bookflowr.com/.

For any privacy or data protection question, contact us at bookflowr@bookflowr.com. Users located in the European Economic Area (EEA) may direct requests to the same email; we will respond within a maximum of 30 days.

2. Data we collect

  • Account data: name, email, hashed password (bcrypt), preferred language, and business details if you register as a professional.
  • Billing data: legal name, tax ID, billing address, and payment method, processed through Stripe (PCI-DSS Level 1 certified; we do not store full card numbers).
  • Usage and technical data: IP addresses, session identifiers, browser type, operating system, pages visited, access timestamps, and in-platform events.
  • Communications: support messages, survey responses, and any information you voluntarily share.
  • End-customer data of the business: when you use BookflowR to manage your own customers (bookings, notifications, history), BK Modules acts as a data processor; you are the data controller.

3. Purposes and legal bases (GDPR)

  • Service provision (art. 6.1.b — contract performance): creating and managing your account, providing panel access, processing bookings and subscriptions.
  • Billing and tax compliance (art. 6.1.c — legal obligation): issuing and retaining invoices, responding to authority requests.
  • Security and fraud prevention (art. 6.1.f — legitimate interest): event logging, abuse detection, access audits, and service integrity.
  • Essential operational communications (art. 6.1.b — contract performance): account verification, system alerts, and billing notices.
  • Marketing and newsletter (art. 6.1.a — consent): only if you expressly opt in; you may withdraw consent at any time.
  • Service improvement and aggregate analytics (art. 6.1.f — legitimate interest): anonymized usage statistics to improve the platform.

4. Retention periods

We retain your account data while it remains active. After closure, identifying data is deleted or anonymized within thirty (30) days, except data we must retain by law:

  • Invoices and tax records: minimum 6 years (EU accounting/tax obligation).
  • Security and audit logs: up to 12 months.
  • Support communications: up to 3 years from last contact.

5. Processors and recipients

We rely on providers acting as data processors under contract (art. 28 GDPR):

  • Stripe, Inc. (United States), with Stripe Payments Europe Ltd. (Ireland, EU) for EEA users — payment processing and billing.
  • Cloud infrastructure providers — hosting and databases, preferably within the EU.
  • Transactional email providers — system email delivery.
  • Meta Platforms Inc. (WhatsApp Cloud API) and Telegram — only if the business enables these notification channels.
  • Google LLC — embedded maps and, if the business enables it, analytics (GA4) and tags (GTM).

BK Modules does not sell or share personal data with third parties for their own commercial purposes.

6. International transfers

BK Modules is established in the United States. Data is transferred to and processed in the US and, where applicable, within the EU. To ensure the lawfulness of transfers from the EEA, we rely on the following mechanisms:

  • EU-US Data Privacy Framework (DPF, July 2023): for providers certified under the DPF.
  • EU Standard Contractual Clauses (SCCs) approved by the European Commission: for providers not covered by the DPF.
  • European Commission adequacy decisions: where applicable to the recipient country.

7. Your rights (GDPR — EEA users)

If you are in the European Economic Area, you may exercise the following rights at any time:

  • Access: obtain confirmation of whether we process your data and receive a copy.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure ("right to be forgotten"): request deletion of your data when no longer necessary or when you withdraw consent.
  • Objection: object to processing based on legitimate interest.
  • Restriction: request suspension of processing under certain circumstances.
  • Portability: receive your data in a structured, commonly used format.
  • Not to be subject to solely automated decisions with legal or similarly significant effects.

Write to bookflowr@bookflowr.com indicating your name, account email, and your specific request. We will respond within 30 days. If you believe we have not handled your request properly, you may lodge a complaint with the supervisory authority in your country (in Spain, the AEPD — www.aepd.es).

8. Additional rights — California residents (CCPA/CPRA)

If you reside in California (USA), the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) grant you additional rights:

  • Right to know what personal information we have collected, the purpose of collection, and to whom it has been disclosed.
  • Right to delete your personal information, subject to legal exceptions.
  • Right to correct inaccurate personal information.
  • Right not to be discriminated against for exercising your rights.
  • Right to opt out of the sale or sharing of personal information: BK Modules does not sell personal data.

9. Minors

The Service is intended exclusively for individuals over 18 years of age. We do not knowingly collect personal data from individuals under 18 years old. If you believe a minor has provided us with data without parental or guardian consent, contact us at bookflowr@bookflowr.com and we will promptly delete such data.

10. Automated decisions and profiling

We do not make decisions with significant legal effects based solely on automated processing. Fraud detection and validation mechanisms are used only as decision-support tools, always under the supervision of qualified human staff.

11. Changes to this policy

We may update this Policy to reflect legal, regulatory, or service changes. Substantial changes will be notified by email or via a panel notice at least fifteen (15) days in advance. The date at the top of this page indicates the last published update. Continued use of the Service after the effective date constitutes acceptance of the revised Policy.

Non-essential cookies are not loaded until the user accepts them through the consent panel.

3. Embedded content (maps and videos)

To avoid degrading the user experience, this site may display embedded maps and videos using privacy-oriented variants: Google Maps Embed API and OpenStreetMap/Leaflet for maps, and youtube-nocookie.com for videos. These integrations do not set advertising cookies until the user interacts with the content. The provider may receive technical data (IP, user agent) necessary to deliver the content. This loading relies on the legitimate interest of displaying requested content and, for certified US providers, on the EU-US Data Privacy Framework.

4. Consent management

Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "Customer") and BK Modules, a limited liability company organized under the laws of the State of New Mexico (United States), owner of the BookflowR service available at https://bookflowr.com/ ("the Service"). By accessing or using the Service, you fully and unconditionally accept these Terms. If you do not agree, you must not use the Service.

1. Subject matter

BookflowR is a software-as-a-service (SaaS) platform that enables professionals and small businesses to manage bookings, customers, communications, and payments online. These Terms govern all relationships between BK Modules and the User from the moment of registration or first access.

BookflowR is an exclusively professional and business-to-business (B2B) service. By registering and using the Service, you declare and warrant that you are acting in the course of your commercial, business, craft, or professional activity, and not as a consumer for personal purposes. The Service is not directed at end consumers within the meaning of Directive 2011/83/EU or equivalent national consumer protection law.

2. Registration and account

To access the management panel you must register an account with truthful, accurate, current, and complete information, and keep it updated at all times. You are solely responsible for the confidentiality of your credentials and for any activity carried out under your account. Registration and use of the Service is restricted to individuals over 18 years of age and to legal entities acting through representatives with sufficient legal authority. BK Modules may request identity verification or proof of authority to contract at any time.

3. Plans, subscription, and billing

BookflowR offers subscription plans whose features and pricing are detailed at https://bookflowr.com/. The subscription begins upon registration and plan selection, with charges processed automatically and periodically (monthly or annually) through the payment provider Stripe. Given the professional (B2B) nature of the Service, the right of withdrawal provided under consumer protection law — including Directive 2011/83/EU, Directive (EU) 2023/2673, and equivalent national regulations — does not apply to this contract. Amounts already billed are non-refundable. You may cancel your subscription at any time from the panel; the Service remains active until the end of the current billing period. BK Modules reserves the right to modify prices with a minimum of thirty (30) days' notice via email or the panel; continued use constitutes acceptance of the new prices.

4. Acceptable use and prohibited conduct

You agree to use the Service solely for lawful purposes consistent with these Terms. Without limitation, the following are expressly prohibited:

  • Engaging in illegal activities or activities that infringe third-party rights.
  • Attempting to access systems, accounts, or data without authorization.
  • Reverse engineering, decompiling, disassembling, or extracting the source code of the software.
  • Conducting mass scraping, automated crawling, or using bots without prior written authorization.
  • Sending spam, malware, ransomware, phishing, or any malicious or unlawful content.
  • Impersonating BK Modules, its employees, or any third party.
  • Reselling, sublicensing, or transferring access to the Service without prior written authorization from BK Modules.
  • Interfering with the functioning, security, or availability of the Service.
  • Harvesting contact data without consent.

Violations may result in immediate account suspension or termination, without prejudice to any civil and/or criminal legal actions BK Modules deems appropriate.

5. Intellectual property and brand protection

BK Modules owns or is licensed to use all intellectual and industrial property rights in BookflowR, including, without limitation: source code, software, platform architecture, visual design, algorithms, trademarks, logos, trade names, texts, images, and iconography.

The name "BookflowR", the associated logo, and all derivatives are protected trademarks and the exclusive property of BK Modules. Their use, reproduction, imitation, dilution, registration, or exploitation — in any form or jurisdiction — without prior written authorization is expressly prohibited. Infringement will result in civil and criminal claims to the fullest extent permitted by law.

Subscribing to the Service grants the User only a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service during the subscription period. No ownership rights in the software or any component of the Service are transferred. Any feedback, suggestions, or improvements you provide regarding the Service may be used by BK Modules without restriction or additional compensation.

6. End-customer data and sub-processing

In the context of booking and communication management activities carried out through the Service, BK Modules acts as a data processor with respect to end-customer data managed by the User, with the User being the data controller under the GDPR and applicable law. The User warrants that they have the appropriate legal basis to process their customers' data, have provided legally required notices, and that their use of BookflowR is compatible with data subjects' rights. BK Modules will process such data only per the User's documented instructions and will delete or return it upon contract termination as agreed.

7. Service availability and disclaimer of warranties

BookflowR makes reasonable efforts to keep the Service available on an uninterrupted basis, but does not guarantee continuous, error-free, or uninterrupted availability. Outages may occur due to maintenance, updates, or force majeure.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent applicable law does not permit complete exclusion of these warranties, such exclusion applies to the maximum extent permitted.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BK Modules SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, REPUTATION, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BK Modules's total cumulative liability to the User, for any cause, shall not exceed the total amount actually paid by the User during the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (USD 100) if no payment was made during that period. Some jurisdictions do not allow the limitation or exclusion of certain liabilities; in such cases, these limitations apply to the maximum extent permitted by law.

9. User indemnification

You agree to indemnify, defend, and hold harmless BK Modules and its officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in breach of these Terms; (b) violation of third-party rights; (c) unlawful processing of end-customer data; or (d) any content or operation performed under your account.

10. Term, suspension, and termination

These Terms take effect upon registration and remain in force for the duration of the subscription. Either party may terminate the agreement by canceling the account. BK Modules may suspend or cancel access immediately in the event of a material breach of these Terms, fraudulent use, or illegal activities, without prejudice to any claims for damages. Upon termination, BK Modules may delete account data no sooner than thirty (30) days after termination, except where retention is required by law.

11. Modifications to these Terms

BK Modules may modify these Terms at any time. Material changes will be notified via email or a panel notice with a minimum of fifteen (15) days' prior notice. Continued use of the Service after that period constitutes acceptance of the revised Terms. If you do not accept the changes, you must cancel your subscription before they take effect.

12. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-law principles, and without prejudice to mandatory consumer protection provisions of the User's country of residence. The parties agree to attempt to resolve any dispute amicably within thirty (30) days of written notice. Failing agreement, disputes shall be submitted to the courts of Albuquerque, New Mexico (USA), unless mandatory law in the User-consumer's country of residence establishes different jurisdiction. If any provision is found invalid, the remaining provisions shall remain in full force. Failure to exercise any right shall not constitute a waiver. These Terms constitute the entire agreement between the parties on the subject matter hereof.

13. Messaging and third-party API costs (WhatsApp, etc.)

The Service lets you send notifications to end customers through third-party platforms (for example, Meta's WhatsApp Business Platform), which may incur a cost. Two options are available, either of which may or may not be offered at any given time and which remain disabled by default until the User expressly accepts the applicable tariff:

  • (a) User's own account. The User connects their own Meta/WhatsApp account and pays the tariffs set by Meta directly to Meta, as per Meta's pricing in force from time to time. BK Modules does not take part in or guarantee that billing.
  • (b) Managed auto-configuration by BK Modules (subject to availability). BK Modules provides the connection and the User pays BK Modules's tariffs for the messages sent, which are added to the monthly fee and charged together with the subscription via Stripe. By enabling this option, the User expressly accepts such variable, usage-based charges.
Third-party platform tariffs vary by provider, country, and message category, and can be consulted in the provider's official documentation. BK Modules may enable, disable, or modify either option and its tariffs in accordance with the modifications clause. In both cases, the User is responsible for their use of such platforms and for compliance with the platforms' policies.

5. Prohibited activities

6. Governing law and jurisdiction
